I need to sell a North Park house with a tenant in it. Who should I talk to?
Talk to an agent who has sold occupied homes, then talk to your tenant. A building of four or more units usually sells with the tenants in place. A house or small multi-unit someone could live in is usually worth more vacant. I'm Jared Harman, a North Park REALTOR®, and I've sold a handful of homes with tenants in them.
Should I sell with the tenant in place, or wait until it is vacant?
It depends on the situation and the property type. Selling with tenants can be tricky, and at times extremely challenging.
With three or four units, and especially with more than four, you're probably better off leaving the tenants in place.
Below that, if it's a property someone would want to buy and live in, at least in one of the units, it gets interesting. You either keep a good relationship with the tenant so the next owner has a smooth transition, or you give the tenant a reason to move on.
Is a vacant house worth more than an occupied one?
Typically, yes. Vacant properties do better than occupied ones, and that's just how it is.
A buyer either wants to make improvements or charge market rent. A tenant in place gets in the way of both.
The exception: if the unit already rents at a market rate, the next buyer probably won't have any issue with it.
How do I get a tenant to move out before I sell?
Start by asking about their plans. You don't know without asking, and they may already be thinking about moving. Sometimes all it takes is waiting another month or two.
Another option is cash for keys, where you pay the tenant to leave on an agreed date. It's a voluntary agreement. After a tenant has lived there 12 months, California's Tenant Protection Act generally requires just cause to end it, and an owner moving in is one of the no-fault causes, with relocation assistance equal to one month of rent (Civil Code 1946.2). The act has exemptions.
The City of San Diego has its own tenant protection ordinance, which the city says goes beyond the state standards in some areas (City of San Diego). A landlord-tenant attorney tells you what applies to your property before you make any offer to a tenant.
What happened when I sold a North Park property with tenants in it?
We sold a property in North Park in 2026 with a front house and two units in the back. The front house was vacant, because it had been the seller's own home. The two back units were occupied, and we sold them occupied, as part of the sale.
We did our absolute best to cooperate with those tenants and respect their time, their space and their energy. When we had extra pastries or food left over from our events, the tenants were absolutely getting some. They were accommodating, and they helped us sell that property and find them a new landlord, and a new neighbor.
That's exactly what happened. The buyers moved into the front house and kept the same tenants in the back. All was fine and dandy.
What do owners get wrong about selling a rental before they call an agent?
There's a lot of misunderstanding about what you actually need to do, and the best way to do it.
Some owners try to cut the tenant out of it entirely: sell it occupied, tell the tenant nothing, and just pass the title to somebody else.
There's a much better way. Forthright, clear communication with the tenant can end up putting more money in your pocket.
It also matters for showings. To show a unit to buyers, California requires reasonable notice to the tenant, presumed to be 24 hours, in writing unless they've already been told in writing that the property is for sale, and entry during normal business hours (Civil Code 1954).
What does this mean if you are selling a rented home in North Park?
If it's a duplex or a small multi-unit, here's what North Park duplex buyers look for. And if the house came to you through an estate, start with the title.
Want the number first? Tell me about the property and I will personally research what you would actually walk away with, occupied or vacant. That is a Net Number, back to you in 24 hours.
